Welcome to Live DJ, a platform connecting event organizers with professional DJs. These terms and conditions ("Agreement") govern your access to and use of the Live DJ website and mobile application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, you may not access or use the Service.
The Service is intended solely for individuals who are 18 years of age or older. By accessing or using the Service, you represent and warrant that you are at least 18 years old.
You may use the Service to browse and book DJs for your event. You may not use the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
To access certain features of the Service, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify Live DJ of any unauthorized use of your account or any other breach of security.
Booking a DJ through Live DJ may require payment of a fee. Live DJ reserves the right to change the fee at any time. Payment of the fee is required in full at the time of booking. All payments are final and non-refundable unless otherwise specified in this Agreement or required by law.
Live DJ is not responsible for the services provided by the DJs booked through the Service. The DJs are independent contractors and not employees or agents of Live DJ. Live DJ makes no guarantees as to the quality or availability of the DJs or their services.
The Service and its content, including without limitation the Live DJ logo, graphics, text, and software, are protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works of the Service or its content without Live DJ's express written consent.
The Service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. Live DJ does not warrant that the Service will meet your requirements, that the Service will be uninterrupted, timely, secure, or error-free, or that any errors in the Service will be corrected.
In no event shall Live DJ be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service, whether or not Live DJ has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Live DJ and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service or your violation of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any principles of conflicts of law.
Any disputes arising under or related to this Agreement, or the Service shall be resolved exclusively through binding arbitration conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
